Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website located at pulptale.com and any related applications or services (collectively, the "Service"), operated by Haodayige Co., Ltd. ("we," "us," or "our"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

1.1 You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to create an account and make purchases on the Service.

1.2 If you are between 13 and 18 years old (or the applicable age of majority), you may browse free chapters only with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf.

1.3 The Service is not directed to children under 13, and we do not knowingly permit their use. See our Privacy Policy for more information.

2. Accounts

2.1 We sign you in with a one-time link sent to your email address. You must provide an address you control and keep access to it secure; anyone with access to your inbox can sign in as you.

2.2 You are responsible for all activity that occurs under your account. Notify us immediately at support@pulptale.com of any unauthorized use.

2.3 We may suspend or terminate accounts that violate these Terms, engage in fraud, or abuse the Service.

3. The Service and Content

3.1 The Service provides access to digital entertainment content, consisting of short serialized fiction ("Content").

3.2 Every story has a number of free chapters that anyone can read. The remaining chapters are available to members. Membership is sold as a recurring subscription in the plans shown at checkout (currently weekly and monthly).

3.3 Membership grants a personal, non-transferable, non-exclusive licence to read Content for personal, non-commercial use for as long as the membership is active. No ownership of the Content is transferred.

3.4 Content availability, catalog composition, and pricing may change over time. Removal of Content from the catalog does not entitle you to a refund except as described in our Refund Policy.

4. AI-Generated Content Disclosure

4.1 Some or all of the Content on the Service is generated or assisted by artificial intelligence tools, including text and cover artwork. See our AI Content Policy for full details.

4.2 By using the Service, you acknowledge that Content may be AI-generated or AI-assisted and agree to the terms of the AI Content Policy.

5. Payments, Automatic Renewal, and Cancellation

5.1 All purchases are processed by third-party payment processors ("Payment Processors"). By making a purchase, you agree to the applicable Payment Processor's terms of service.

5.2 Prices are stated in USD unless otherwise indicated and are inclusive/exclusive of applicable taxes as stated at checkout.

5.3 Automatic renewal. Subscriptions renew automatically at the standard price until cancelled; cancel anytime from your account page and access continues to the end of the paid period; the introductory price applies to the first billing period only.

5.4 The price, the billing period, the renewal price, and the date of the next charge are shown before you pay and again on your account page. We will tell you by email before any change to the renewal price takes effect.

5.5 Cancelling stops future charges. It does not, by itself, refund the period you have already paid for; refunds are governed by our Refund Policy.

6. User Conduct

You agree not to:

• Circumvent, disable, or interfere with access controls, paywalls, or membership restrictions.
• Reproduce, distribute, publicly perform, or create derivative works from Content without our prior written consent.
• Use automated means (bots, scrapers) to access the Service without authorization.
• Upload or transmit content that is unlawful, infringing, defamatory, or that violates the rights of others.
• Attempt to reverse engineer, decompile, or extract source code or models underlying the Service.
• Use the Service in a manner that could disable, overburden, or impair it.

7. Intellectual Property

7.1 The Service and all Content, trademarks, logos, and underlying software are owned by Haodayige Co., Ltd. or its licensors and are protected by copyright, trademark, and other intellectual property laws.

7.2 Original Content produced by Haodayige Co., Ltd. is original work; see the originality statement in our AI Content Policy.

7.3 If you believe Content on the Service infringes your copyright, see Section 8 (DMCA).

8. DMCA / Copyright Complaints

We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA") and equivalent laws in other jurisdictions. To submit a notice, send the following to our designated agent:

• Identification of the copyrighted work claimed to be infringed.
• Identification of the material claimed to be infringing, with enough detail for us to locate it (e.g., URL).
• Your contact information (name, address, phone number, email).
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
• Your physical or electronic signature.

We will remove or disable access to material that is the subject of a valid notice and may terminate accounts of repeat infringers.

9. Disclaimers

9.1 THE SERVICE AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that AI-generated Content will be free of inaccuracies or artifacts.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Haodayige Co., Ltd. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF the amount you paid us in the 12 months before the claim, or USD 50, whichever is greater OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Haodayige Co., Ltd. from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Service.

12. Governing Law and Dispute Resolution

12.1 These Terms are governed by the laws of the laws of the People's Republic of China (excluding Hong Kong, Macau and Taiwan), without regard to its conflict-of-law principles.

12.2 Any dispute arising out of or relating to these Terms or the Service will be resolved in the courts located in the people's court with jurisdiction in Shenyang, Liaoning, China, and you consent to the personal jurisdiction of such courts.

12.3 You agree to first attempt to resolve any dispute informally by contacting support@pulptale.com; we will attempt to resolve the dispute informally for at least 30 days before either party initiates formal proceedings.

13. Changes to the Service and Terms

13.1 We may modify or discontinue any part of the Service at any time.

13.2 We may update these Terms from time to time. Material changes will be notified via the Service or by email. Continued use after changes take effect constitutes acceptance of the revised Terms.

14. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. Sections 7 through 11 survive termination.

15. Miscellaneous

15.1 If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

15.2 These Terms, together with the Privacy Policy, Refund Policy, and AI Content Policy, constitute the entire agreement between you and Haodayige Co., Ltd. regarding the Service.
